General terms and conditions for online language courses

After expiry of the booked lessons you do not need to re-register, as the renewal is automatic from month to month. If you no longer intend to participate in the course after the expiry of the booked lessons or time, please do not forget to cancel in a written form. The notice period is one month. No notice is required for intensive courses or individual lessons.

By bank transfer: The relevant account number will be on the invoice. Please send us a copy of the transfer order. All bank charges will be incurred by you. By credit card: Upon your notification, the appropriate form will be sent. It will need to be completed with the name of the credit card issuer, card number, expiry date and signature. An additional 2% credit card fee will be charged.

SPRACHCAFFE is entitled to exchange the announced trainer for an equivalent trainer if there is an important reason, especially in the event of illness of the trainer. In the unlikely event the school is unable to create a group course due to an insufficient number of students of the same level, smaller classes for a reduced number of lessons will be provided instead (standard = 12 lessons / intensive = 18 lessons, i.e. standard + 6 one to one lessons). The minimum number of participants is 4. Under the rare circumstances of our being forced to cancel, all fees paid for SPRACHCAFFE services will be refunded. Changes and deviations of individual services from the agreed content which become necessary after conclusion of the contract and which were not caused by us contrary to good faith are permitted. Provided that the changes or deviations are not substantial and do not impair the overall design of the service. Complaints regarding the contractually agreed services must be reported so that remedial action can be taken immediately. If the participant culpably fails to report a defect and if SPRACHCAFFE is not given the opportunity to remedy the defect, a reduction of the price is excluded.

Interruptions due to illness and/or holidays in a continuous course (such as evening classes) are possible after arrangement. There is no substitute for missed lessons. Appointments for individual lessons must be cancelled 48 hours in advance!

The participant enters the virtual training room on the specified date according to the information in the registration confirmation or in the login area. Any technical requirements necessary for the training are also specified there. In any case, the participant needs a stable internet access, a common browser or an Android or iOS mobile phone. The installation of an additional plug-in or app may be necessary. In the run-up to an online language course, the participant must check his computer system with the help of the Cisco Test Meetings (https://www.webex.com/test-meeting.html). If the check shows that the system is insufficient, the participant must ensure that the technical requirements are met. SPRACHCAFFE does not accept any liability for the accuracy or topicality of the lectures and training documents.

You can resign at any time. In your own interest and to avoid misunderstandings, we strongly recommend that you declare your withdrawal in writing. Decisive for the calculation of the cancellation costs is the time of receipt of the cancellation notice by SPRACHCAFFE:

• up to 15 days before the start of the course: 50 % of the course costs max. 500 EUR
• up to 3 days before the start of the course: 90 % of the course costs max. 1000 EUR
• After course start: 100%

SPRACHCAFFE expects the participant to respect the customs, traditions and laws of the host country. If, despite a warning, a participant disrupts the course or behaves in gross violation of the contract, SPRACHCAFFE has the right to cancel without notice. The organizer retains the right to full payment; any expenses saved will be credited to the participant.

The parties agree not to headhunt or employ, directly or indirectly, any permanent or freelance employees of each other. In the event of a violation of the prohibition of poaching, the party in violation of the contract is obliged to pay a contractual penalty of up to EUR 10,000.

Claims arising from the contract become time-barred within two years. This limitation period begins on the day on which the language course was to end. The claiming of other entitlements remains unaffected by this regulation.

RIGHTS TO THE IMAGE

Occasionally meetings are recorded for quality assurance purposes. By agreeing to our general terms and conditions, you are accepting that SPRACHCAFFE has the right to use any photos, video and sound recordings, which may be produced in the course of a language programme. These materials may be used by us for promotional purposes without cost implication or the need for a separate authorization from you. You can always retract your agreement to let us process your data as well as your agreement to let us use your personally identifying data. Please email info@sprachcaffe.com in order to do this.

While all information in this is accurate at the time of publication, the content may be subject to updates. We reserve the right to refuse admission or to dismiss any student from school/accommodation without any refund in the event of misconduct or unsatisfactory attendance. The school expects students to adhere to the rules set. Errors and changes are reserved.

The place of jurisdiction for legal action by registered traders against SPRACHCAFFE is exclusively in Malta. Otherwise, the statutory regulations apply.
